Terms of Service
1. Agreement
These Terms of Service (“Terms”) are an agreement between you, the home health agency or organization using SaferNote (“you”, “Customer”), and WeCreate, a company registered in Israel, at Laskov 9, Rehovot, Israel, which operates SaferNote (“we”, “us”). By creating an account or using the service, you agree to these Terms. If you use SaferNote on behalf of an organization, you confirm you are authorized to bind it.
2. The service
SaferNote is a visit note quality review service. Our home health documentation experts review the visit notes you send us against CMS Medicare documentation rules and the home health requirements of your state, and gives you a report of documentation gaps to fix. Every note is reviewed by a person on our team; we do not use artificial intelligence to review them.
3. What the service is not
- SaferNote is not legal, billing, coding or medical advice.
- We do not guarantee that any claim will be paid, or that a note will pass an audit, ADR or survey. Payers and auditors make their own decisions.
- We are not affiliated with CMS, Medicare or any government agency.
- Your agency and its clinicians remain responsible for patient care, for the content of every note, and for all billing decisions.
4. Your responsibilities
- Send only visit notes you are legally allowed to share with us for review.
- Keep your account credentials secure and tell us promptly about any unauthorized use.
- Give us accurate account, agency and billing information.
- Do not misuse the service, attempt to access other customers’ data, or interfere with its security.
5. Privacy, security and HIPAA
How we handle information is described in our Privacy Policy. Visit notes are encrypted, used only to perform the review, never shared or sold, and permanently deleted once the review is completed. Where your notes contain Protected Health Information, we will sign a HIPAA Business Associate Agreement (BAA) on request, and the BAA governs our handling of that information.
6. Pricing and payment
- You pay per visit note reviewed: $2.00 per note, or $1.80 per note once you send more than 1,000 notes in a calendar month.
- Your first 30 notes are free.
- There is no subscription and no minimum commitment.
- Fees are billed monthly for the notes reviewed in the previous month, unless we agree otherwise in writing. Prices exclude any applicable taxes.
- We may change our prices with at least 30 days’ notice. Changes do not apply to notes already sent for review.
7. Custom integrations
If we build a custom integration with your systems, its scope, timeline and any fees will be agreed with you in writing before work begins.
8. Ownership
You keep all rights in your visit notes and data. The review reports we prepare for you are yours to use within your organization. We keep all rights in the SaferNote service, website, methods and materials.
9. Confidentiality
Each party will keep the other party’s confidential information private and use it only to perform or receive the service.
10. Limitation of liability
To the fullest extent allowed by law, we are not liable for indirect, incidental or consequential damages, including denied or recouped claims, lost revenue or lost profits. Our total liability for any claim relating to the service is limited to the fees you paid us in the three (3) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
11. Ending the service
You may stop using SaferNote at any time. We may suspend or end access if you seriously breach these Terms. When the service ends, you pay for notes already reviewed; any notes still waiting for review are deleted, and we delete your results on request as described in the Privacy Policy.
12. Changes to these Terms
We may update these Terms from time to time. We will post the new version here and notify account holders of important changes by email. Continuing to use the service after changes take effect means you accept them.
13. Governing law
These Terms are governed by the laws of the State of Israel. Any dispute will be brought exclusively in the competent courts of Tel Aviv-Yafo, Israel, unless the law requires otherwise.
